As mentioned at the beginning of this privacy policy, Convergent consists of several international entities and any information that we collect or that you provide to us may be shared and processed by any Convergent entity. We may also share personal information with a variety of the following categories of third parties as necessary:
Please note this list is non-exhaustive and there may be other examples where we need to share with other parties to provide our services as effectively as we can.
We require all third parties to respect the security of your personal data and to treat it in accordance with the law. We do not allow our third-party service providers to use your personal data for their own purposes and only permit them to process your personal data for specified purposes and in accordance with our instructions.
In order to provide our services to you, we may need to transfer your personal information to locations outside the jurisdiction in which you provide it. This may involve sharing your personal data within the Convergent group of entities located outside the UK. All the Convergent entities have signed a data sharing agreement to ensure we will comply with our legal and regulatory obligations in relation to personal information, including having a lawful basis for transferring personal information and putting appropriate safeguards in place to ensure an adequate level of protection for the personal information.
Some of our external third parties are based outside the UK so their processing of your personal data will also involve a transfer of data outside the UK. Whenever we transfer your personal data out of the UK, we ensure a similar degree of protection is afforded to it by ensuring at least one of the following safeguards is implemented:
Please contact us if you want further information on the specific mechanism used by us when transferring your personal data out of the UK.
We have put in place appropriate security measures to prevent your personal data from being accidentally lost, used or accessed in an unauthorized way, altered or disclosed. In addition, we limit access to your personal data to those employees, agents, contractors and other third parties who have a business need to know. They will only process your personal data on our instructions, and they are subject to a duty of confidentiality.
We have put in place procedures to deal with any suspected personal data breach and will notify you and any applicable regulator of a breach where we are legally required to do so.
We will only retain your personal data for as long as reasonably necessary to fulfil the purposes we collected it for, including for the purposes of satisfying any legal, regulatory, tax, accounting or reporting requirements. We may retain your personal data for a longer period in the event of a complaint or if we reasonably believe there is a prospect of litigation in respect to our relationship with you.
To determine the appropriate retention period for personal data, we consider the amount, nature and sensitivity of the personal data, the potential risk of harm from unauthorized use or disclosure of your personal data, the purposes for which we process your personal data and whether we can achieve those purposes through other means, and the applicable legal, regulatory, tax, accounting or other requirements.
Details of retention periods for different aspects of your personal data are available in our retention policy, which you can request from us by contacting us.
In some circumstances we will anonymize your personal data (so that it can no longer be associated with you) for research or statistical purposes, in which case we may use this information indefinitely without further notice to you.
Under certain circumstances, you may have rights under data protection laws in relation to your personal data, as follows:
Please note that some of these rights may be limited where we have an overriding interest or legal obligation to continue to process the data or where data may be exempt from disclosure due to reasons of legal professional privilege or professional secrecy obligations.
You will not have to pay a fee to access your personal data (or to exercise any of the other rights). However, we may charge a reasonable fee if your request is clearly unfounded, repetitive or excessive. Alternatively, we could refuse to comply with your request in these circumstances.
We may need to request specific information from you to help us confirm your identity and ensure your right to access your personal data (or to exercise any of your other rights). This is a security measure to ensure that personal data is not disclosed to any person who has no right to receive it. We may also contact you to ask you for further information in relation to your request to speed up our response.
We try to respond to all legitimate requests within one month. Occasionally it could take us longer than a month if your request is particularly complex or you have made a number of requests. In this case, we will notify you and keep you updated.
In this section, we provide additional information to California residents, as required under California privacy laws, including the California Consumer Privacy Act ("CCPA"). You can opt out at any time using Consent Preferences. We treat a Global Privacy Control signal sent by your browser as a valid request to opt out of the sale and sharing of personal information associated with that browser. We do not knowingly sell or share the personal information of consumers under 16 years of age.
Where we collect sensitive personal information (for example, Social Security, driver's license or passport numbers, account and financial details, or health information in the course of background screening or client engagements), we use and disclose it only for purposes permitted under the CCPA, such as performing the services you request, ensuring security and integrity, and complying with law. We do not use or disclose sensitive personal information to infer characteristics about you.
We retain each category of personal information for as long as reasonably necessary for the purposes described in this policy, as explained in Section 8.
Subject to certain exceptions, California residents have the following rights:
